Supreme Court Clarifies Bail for Foreigners under UAPA: No Bar if Entry is Legal

Exams:UPSCBPSCUPPSCJPSCDefence

The Supreme Court has ruled that there is no blanket prohibition on granting bail to foreign nationals under the Unlawful Activities (Prevention) Act (UAPA). The Court upheld that if a foreigner's entry into India was legal and authorized, the stringent bail conditions under Section 43D(7) of UAPA do not automatically apply, shifting the burden of proof regarding illegal entry onto the prosecution.

Exam notes

  • Full form of UAPA: Unlawful Activities (Prevention) Act
  • Key UAPA Section: Section 43D(7)
